4. Product Representation

We make every reasonable effort to ensure that product information and imagery are accurate. However, natural stone, quartz, and other materials may vary in color, texture, and pattern. Final installed product may differ from samples or online images.

5. Quotes and Orders

Quotes issued by Distinctive Kitchen are valid for 15 calendar days unless otherwise stated. Acceptance of a quote constitutes agreement to the scope of work, materials, and payment terms described. All orders are subject to final field measurements, availability, and approval.

6. Payment Terms

Unless otherwise agreed in writing, payment is due upon completion of installation. We reserve the right to require partial or full deposits for custom materials. Late payments may be subject to service charges, lien rights, or collections action. Returned checks are subject to applicable bank fees.

7. Warranties

Labor is warrantied for one year from installation date. Material warranties are provided directly by the manufacturer, if applicable. Clearance, remnant, and discontinued products are sold as-is without warranty. Warranty does not cover misuse, abuse, negligence, or improper maintenance.

8. Returns and Cancellations

Custom products are not eligible for return or refund. Orders canceled after fabrication or material allocation may incur restocking or disposal fees. All cancellations must be submitted in writing and are subject to confirmation and approval.

9. Limitation of Liability

To the maximum extent permitted by law, Distinctive Kitchen shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the website or products and services, including installation. Our total liability is limited to the amount paid by you for the applicable service.

10. Force Majeure

We shall not be held liable for delays or failure in performance due to causes beyond our control, including but not limited to natural disasters, labor strikes, supply shortages, governmental action, transportation delays, or acts of God.

11. Privacy and Data Collection

We collect, store, and process personal data as outlined in our Privacy Policy. By using our site or submitting a form, you consent to such processing. We implement commercially reasonable security measures to protect your data but cannot guarantee absolute security.

Personal information collected through SMS or form submission is processed and protected in accordance with our Privacy Policy. We retain SMS opt-in records for at least 12 months or longer as required.

We do not send unsolicited promotional or marketing texts unless you separately opt into such a campaign. All messages are strictly transactional or operational in nature.

We retain records of consent, including form submissions and time/date of opt-in.
